JINS App Terms of Use

These Terms of Use set out the terms and conditions for your use of the JINS App, a smartphone app provided by JINS Hong Kong Limited (“JINS”). Please read these Terms of Use very carefully and agree to them before you start using the JINS App.

Article 1. Scope of these Terms of Use
These Terms of Use apply to JINS and you in relation to the provision and use of the JINS App. By using the JINS App, this shall be deemed to mean that you have.
(i) read and understood the Terms of Use; and
(ii) accepted these Terms of Use and agreed to be unconditionally bound.

Article 2. Use of the JINS App
Your use of JINS App is governed by these Terms of Use. The JINS App can only be used in the Hong Kong Special Administrative Region.

Article 3. User Registration

  1. You may register to use the JINS App by registering your email address and password or by entering your ID for JINS’ external partner service providers such as Facebook and LINE, etc.
  2. Parent or guardian’s consent is required before a minor can be registered as a user of the JINS App.
  3. You are responsible for managing your registered email address, password, and the user code issued to you and must not allow any third parties to use them. JINS will not be liable in any way for any loss, damage, or expense that may be caused or incurred in connection with the fraudulent use, misuse, or use by third parties of, or unauthorized access, etc. to, your email address, password, or user code.
  4. Any login of your registered account will be deemed to be accessed by you personally, regardless of whether the said access is authorized by you or not.

Article 4. Change to Registered Information

  1. You may check your registered information from your account on the JINS App.
  2. You must promptly inform JINS of any changes to your registered information.
  3. In the event that any omission or delay in communication or issuing of reward etc. from JINS was as a result of your failure to adequately provide correct registered information to us, such communication or issuing of reward shall be deemed to have been sent or issued to you in its ordinary course should you have adequately provided us with the necessary information and JINS will not be liable for any loss, damage, inconvenience or disadvantage that may be caused to you as a result thereof.

Article 5. User Registration Fees and Annual Fees
No user registration fees or annual fees, etc. are payable for registering as a JINS App user.

Article 6. Award Miles

  1. JINS awards you with miles in accordance with your use of the JINS App and your purchases, etc. made at JINS retail stores in Hong Kong. Your miles are valid for 365 days from the day they are last awarded.
  2. Miles are not exchangeable for cash and shall automatically lapse on the expiry of their validity.

Article 7. Issuance of Shopping Coupons

  1. JINS issues shopping coupons at irregular intervals in accordance with your earned miles. Shopping coupons can be used for purchasing JINS products.
  2. Shopping coupons can only be used at selected JINS retail stores in Hong Kong. Please contact any JINS retail store in Hong Kong for more information.
  3. You must not transfer or lend your shopping coupons to any third parties, pledge them as collateral, or otherwise dispose of them.
  4. JINS will not be liable in any way for any loss or theft of shopping coupons or other benefits provided to you.

Article 8. Management of Warranty Information

On the JINS App, you may manage and view warranty information concerning
the products you have purchased. For more information on product warranty periods and warranty details, etc., please visit the Customer Service page on the JINS website.

Article 9. Posting Photographs

  1. You may post images of the products you have purchased on the JINS App. When posting images, you must not do anything that may infringe any right of any third party or disturb public order and morality.
  2. Images you post as well as your registered nickname will be made available for viewing by other JINS App users.
  3. JINS may refuse to publish or may delete images that JINS deems inappropriate.

Article 10. Issuance of Email Newsletters

For those customers who have agreed to subscribe to email newsletters, JINS may provide information about new products, sales campaigns, nose pad or frame fitting service schedules, content updates, and eye care etc. online.

Article 11. Privacy Policy

Your personal information and/or other information provided to JINS in connection with the JINS App will be processed in accordance with JINS’ privacy policy. For JINS’s privacy policy, please clickhttps://www.jins.com/hk/privacypolicy/

Article 12. User Registration Period and Termination of User Registration

  1. You may remain a JINS App user for an indefinite period.
  2. You may terminate your user registration at any time. If you wish to terminate your user registration, please delete the JINS App and terminate your user registration on the Account Service page of the JINS website.
  3. Upon termination of your user registration, your earned miles and all your rights and rewards with respect to the use of the JINS App will automatically cease to be effective. In addition, upon termination of your user registration, you will have no claims against JINS whatsoever.
  4. Your user registration automatically terminates upon your death.
  5. If, at the time of the termination of your user registration, there is any amount outstanding for products you have purchased, you will not be discharged from your payment obligations even after your user registration has been canceled.

Article 13. Cancellation of User Registration

If it is discovered that any of the events listed below have taken place on your part, JINS may cancel your JINS App user registration or suspend your use of the JINS App. JINS will have no obligations to give any explanation or reason for doing so :

  • You breached these Terms of Use;
  • You used a false identity to register as a user;
  • You are a minor, an incapacitated person or a person being incapable of giving consent;
  • Emails cannot be sent to the email address you entered when you registered as a user;
  • You have been subject to a loss of eligibility, suspension, or termination, etc. under these Terms of Use or any other rules and regulations of JINS;
  • You provided false, incorrect, or insufficient information when you entered your information;
  • JINS suspects that you are or act as a member of any unlawful society or you are dealing with any unlawful society or any member of the same including but not limited to cooperation or involvement in maintenance, operation or management of the said society by the provision of operating funds;
  • You registered as a user more than once; or
  • JINS otherwise believes that it is inappropriate for you to be a registered user.

Article 14. Prohibited Conduct
When using the JINS App, you must not:

  • violate any applicable laws and regulations, these Terms of Use, or any other terms and conditions of JINS;
  • provide false information when registering as a user;
  • fraudulently use email addresses, passwords, or user codes;
  • collect other customers’ information;
  • assume the identity of JINS or any other customer or third party;
  • engage in any advertising, promotional, solicitation, or sales activities on or using the JINS App;
  • do anything that infringes any intellectual property rights, image rights, privacy rights, reputation, credibility, or any other property rights or moral rights of JINS, other customers or third parties, or interests in such rights;
  • do anything that causes inconvenience, disadvantage, or discomfort to JINS or other customers or third parties;
  • do anything to offend third parties;
  • attempt to, regardless of the manner or embodiment, reverse engineer, decompile, disassemble, or analyze the JINS App or software provided by JINS;
  • gain unauthorized access to JINS’ network or system;
  • attempt to place excessive loads on JINS’ network or system;
  • do anything that may interfere with the operation of the JINS App or any other services provided by JINS or disrupt such services;
  • provide benefits or advantages or other assistance to any unlawful society or any member of the same or engage in criminal activities under the pretext of conducting social campaigns, liaise with anti-social forces, or any other similar persons;
  • do anything that disturbs or may disturb public order and morality or otherwise violates or may violate laws and regulations;
  • do anything to directly or indirectly encourage, promote, or facilitate any of the conducts listed in the preceding sub-paragraphs; or
  • do anything similar to any of the conducts listed in the preceding sub-paragraphs or any other things that JINS may deem inappropriate.

Article 15. Intellectual Property Rights

The copyrights and trademark rights to any and all information published on the JINS App, whether as characters or images, including product information, photographs, and images, and any other intellectual property rights in the JINS App are the property of JINS or other legal right holders, including copyright holders, etc. and are protected by applicable laws and regulations. Your use of the JINS App or any other services provided by JINS shall not grant you the right to use such intellectual property rights. You are prohibited from reproducing, duplicating, selling, lending, or otherwise using such information in any way without the permission of JINS or other right holders.

Article 16. Change to and Termination of the JINS App

  1. JINS may change the content of the JINS App or the terms and conditions of use of the JINS App according to these Terms of Use or other rules or terminate or suspend the JINS App at its absolute discretion without prior notice. You must accept and acknowledge these matters in advance.
  2. The changes referred to in the preceding Paragraph shall take effect when JINS announces such changes on the JINS App or its website. By using the JINS App thereafter, you will be deemed to have agreed to the content of the JINS App and the terms and conditions of use that have been changed.
  3. JINS will not be liable in any way for any disadvantage, inconvenience, loss, or damage that may be caused to you in connection with the changes referred to in this Article.

Article 17. Suspension of Service

If any of the following events occurs, JINS may suspend the JINS App in whole or in part without prior notice in order to maintain the satisfactory operation of the JINS App:

Regular or urgent system maintenance is required;

  1. It is difficult to operate the system due to a fire, power outage, or interference by any third party;
  2. It is impossible to operate or provide the JINS App due to force majeure events, including acts of God, wars, and riots;
  3. It is suspected that unauthorized access has been gained to the network or system; or
  4. JINS otherwise believes that it is necessary to suspend the system due to unavoidable circumstances.

Article 18. Disclaimer
1. JINS makes no representations and/or warranties whether express or implied, of any kind whatsoever including but not limited to the following:

  1. The JINS App and the services provided by JINS are fit for your specific purpose and comply with laws and regulations or rules applicable to you;
  2. The JINS App and the services provided by JINS have the functions, merchantability, accuracy, and availability you expect; or
  3. The JINS App and the service provided by JINS are free of defects.

2. JINS will not be liable in any way for any loss or damage that may be caused to you in connection with your use of the JINS App.

3. You will be solely liable for any loss or damage that may be caused to any third party due to your use of the JINS App and you must take appropriate steps to indemnify and hold JINS harmless against all losses, damages, claim, demands, liabilities, costs (including legal costs), and expenses in connection with your use or misuse of the JINS App.

Article 19. Assignment of Rights and Obligations
1. You must not assign, transfer, or otherwise dispose of your status, rights, or obligations arising in connection with the use of the JINS App to any third parties without JINS’ prior written consent.
2. If JINS assigns its business activities relating to the JINS App to any other company, JINS may assign, to an assignee of such business activities, its status, rights, and obligations arising out of its agreement on use in connection with such assignment of its business activities. The assignment of such business activities under this Article shall include company merger, acquisitions, splits and any other business transfers.

Article 20. Governing Law and Court of Competent Jurisdiction
1. These Terms of Use shall be governed by and construed in accordance with the law of Hong Kong Special Administrative Region and each party agrees to submit to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region over all disputes arising out of or in relation to the use of the JINS App.

Article 21. Severability
In the event that any term or provision in these Terms of Use shall be in whole or in part be held to any extent to be illegal or unenforceable under any applicable laws and regulations that term or provision or part shall to that extent be deemed not to form part of these Terms of Use and the enforceability of the remainder of these Terms of Use shall not be affected..

Article 22. Language
Where these Terms of Use are available in Chinese, the English version shall prevail whenever there is a discrepancy between the two versions.

Article 23 Enquiry Clause
